Legal Information and Guidance

Welcome to The Iris Project Inc. (“The Iris Project,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our website and your purchase and/or receipt of services from us. By accessing our site or booking services, you agree to these Terms.

 

Important: We provide non-medical support services. We do not replace medical, nursing, or emergency care. In an emergency, call 911 or your local emergency number.

1) Who We Are

The Iris Project Inc. provides paid support, respite, companionship, transportation/errand assistance, and community engagement services across Northern Alberta. Services may be delivered by service coordinators and vetted support workers.

2) Eligibility & Service Area

  • Services are available to children, youth, adults, caregivers, and families across Northern Alberta.

  • We provide support for individuals of all ages, including family-directed and self-managed care, FSCD-funded services, and private-pay programs.

  • Some services may require a caregiver or guardian to be present, depending on age or care needs.

  • We reserve the right to decline or discontinue services where safety, scope, or capacity limits apply.

  • Certain programs may require an intake process, documentation, or consent forms before service begins.

3) Scope of Services (Non-Medical)

  • Our services are designed to support individuals and families of all ages, including children, youth, adults, and seniors.
    We provide non-medical support that focuses on quality of life, independence, and community inclusion.

  • Services may include:

  • Companionship and caregiver relief — giving caregivers time to rest while ensuring their loved one is safe and supported.

  • Children and youth support — providing social engagement, supervised activities, and respite for families caring for children with disabilities or special needs (including FSCD and self-managed care clients).

  • Daily living assistance — help with light household tasks, meal prep, organization, or errands.

  • Transportation and community access — safe travel to appointments, shopping, school, or recreational outings.

  • Continuing care and community engagement — promoting social participation, connection, and dignity in daily life.

  • We do not provide regulated medical care (such as medication administration, injections, or wound care), legal/financial services, or unsafe/unsanitary tasks.
    If a requested task falls outside of scope or poses a safety risk, our staff may decline or discontinue the task.

 

4) Safety & Conduct (Client Responsibilities)

To keep everyone safe and respected, you agree to:

  • Provide a safe, respectful, and reasonably tidy environment for in-home visits (disclose hazards, pets, smoking, or contagious illness in advance).

  • Accurate and up-to-date information helps ensure safety and the right match of support worker.

  • Treat staff with respect; zero tolerance for harassment, violence, or discrimination.

  • Provide accurate information that affects service delivery (mobility limits, allergies, equipment, building access, etc.).

  • Ensure minors and vulnerable persons have appropriate consent/guardianship in place.

  • Do not request activities that violate laws, safety policy, or these Terms.

 

We may pause or end a visit if conditions are unsafe. Repeated safety concerns may result in service suspension or termination.

 

5) Bookings, Scheduling & Changes

  • Bookings are confirmed by email or within your intake plan.

  • Rescheduling: Please provide 24 hours’ notice where possible.

  • We aim to arrive on time; travel, weather, and road conditions may affect timing. If delayed, we’ll notify you and adjust where feasible.

 

6) Cancellations, No-Shows & Late Changes

  • Cancellation ≥ 24 hours before the scheduled visit: No fee.

  • Cancellation within 24 hours of the scheduled visit:
    A late-cancellation fee may apply, up to 50% of the scheduled visit, to cover staffing and scheduling costs.

  • No-Show (including inability to gain access within 20 minutes):
    May be charged up to 100% of the scheduled visit.

  • Unsafe Conditions:
    If staff must leave due to unsafe or inappropriate conditions, the visit may be charged as a no-show.

 

7) Fees, Travel & Payments

  • Rates are provided in writing during intake or booking and are subject to GST where applicable.

  • Travel/transportation fees may apply (e.g., per-km, parking).

  • Invoices are due upon receipt unless otherwise stated. Late payments may incur admin charges or suspension of services.

  • If third-party funding (e.g., FSCD, self-managed care, or government caregiver supports) applies, you remain responsible for any amounts not covered by that funder.

  • Accepted payment methods include e-transfer, or cheque as outlined on your invoice.

 

8) Transportation & Community Outings

  • When transportation is provided, you must use seatbelts or required restraints and follow the driver's instructions.

  • Mobility aids must be safe and functional.

  • We may refuse travel if conditions are unsafe (e.g., severe weather, non-roadworthy equipment).

  • Drivers reserve the right to cancel or modify travel plans if conditions become unsafe or if proper child restraints are unavailable at the time of pickup.

  • We are not responsible for items lost during outings.

 

9) Funding, Reimbursements & Private Pay

  • We can support clients using self-managed or direct-funding programs (e.g., caregiver support, FSCD) where permissible.

  • You are responsible for understanding your funder’s eligibility, approvals, and reporting.

  • Where a funder denies payment, the client/guardian remains responsible for the invoice.

 

10) Privacy & Personal Information

We collect and use personal information to provide and coordinate services, schedule visits, ensure safety, and comply with legal obligations. We follow applicable privacy laws, including PIPEDA and Alberta’s PIPA.

  • We store data securely and limit access to authorized personnel.

  • We may share relevant information with staff, contractors, or funding partners strictly to deliver services or as required by law.

  • You may request access to or correction of your information.

  • For minors or individuals under guardianship, personal information is collected and shared only with the consent of a parent or legal guardian.

  • We do not sell or trade personal information under any circumstances.

11) Photos, Testimonials & Marketing Consent

  • We do not use client images, stories, or testimonials for marketing without explicit written consent.

  • Consent can be withdrawn at any time for future use.

 

12) Website Use & Intellectual Property

  • The website and its content (text, images, logo) are owned by The Iris Project Inc. and protected by intellectual property laws.

  • You may not copy, distribute, or use content without our written permission.

  • Third-party links are provided for convenience; we aren’t responsible for their content or practices.

 

13) Accessibility

We aim to provide accessible, inclusive services. If you need accommodations to access our website or services, contact us and we’ll work with you to find a solution.

 

14) Disclaimer

  • Services are provided on an “as-available” basis.

  • We do not guarantee outcomes or uninterrupted availability.

  • We do not provide medical, legal, or financial advice.

  • All information provided on this website is for general informational purposes only and is not intended as professional advice.

 

15) Limitation of Liability

To the fullest extent permitted by Alberta law, The Iris Project Inc. and its staff will not be liable for indirect, incidental, special, or consequential damages arising from services or website use. Our total liability for any claim is limited to the amounts paid for the specific service giving rise to the claim. This limitation does not apply to losses resulting from gross negligence or intentional misconduct by The Iris Project Inc. or its representatives.

 

16) Indemnity

You agree to indemnify and hold harmless The Iris Project Inc., its directors, employees, and contractors against claims, losses, or costs arising from (a) your breach of these Terms, (b) misuse of services, or (c) unsafe conditions you control.

 

17) Changes to Services or Terms

We may update services, pricing, or these Terms at any time. The “Effective date” above will reflect the latest version. Continued use or bookings after changes means you accept the updated Terms. Any significant updates will be posted on our website with a revised effective date.

 

18) Governing Law

These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada. Any disputes shall be heard in the courts of Alberta.
